To pass the following resolution:

That, in accordance with section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business as they involve the likely disclosure of exempt information falling within paragraph 1 of Schedule 12A to the Act relating to any individual.

Licensing Act 2003 – Application for a Personal Licence in respect of Mr Dean Martin Allwood

Minutes:

The Chair led round-table introductions and outlined the procedure to be followed.

 

Michelle James, Licensing Policy Manager, outlined the report regarding an application for a Personal Licence, which had been circulated to all parties in advance of the meeting.

 

The Licensing Policy Manager reported that since the agenda had been published, a written statement had been submitted by the Applicant, Dean Martin Allwood. This had been published as supplementary information and copies had been sent to all relevant parties.

 

The Chair invited West Midlands Police to present their application. Sgt Steph Reynolds did so as per appendix 6 of the report.

 

The Chair afforded all parties present the opportunity to question West Midlands Police in relation to her submission. Sgt Steph Reynolds provided responses to questions asked.

 

The Police was afforded the opportunity to make a closing statement.

 

Sgt Steph Reynolds did so.

 

All parties, with the exception of the Solicitor and Democratic Support Officers, withdrew from the meeting to enable the Sub-Committee to determine the matter.

 

All interested parties were invited back to the meeting and the Chair advised them of the decision of the Sub-Committee, which was read out in full by the Solicitor.

 

Resolved:

 

The Sub-Committee considered written submissions from the Applicant and heard from West Midlands Police.

In the circumstances and in accordance with Section 120 of the Licensing Act 2003 the Licensing Sub-Committee decided to refuse the application for a personal licence as it was considered appropriate for the promotion of crime prevention objective.

The decision could be appealed to the Magistrates Court within 21 days from receipt of the decision. In the event an appeal was lodged and dismissed by the Court the Council would apply for its costs in defending the appeal.
