Minutes: An application for a review of a Premises Licence in respect of Wood End Wines, 252 Wood End Road, Wolverhampton, WV11 1YD had been received from Trading Standards.
Before the hearing commenced, Kerryn Woollett, Locum Prosecution and Regulatory Solicitor recommended that an adjournment take place so that all parties could clarify which additional conditions had been agreed.
The Sub-Committee adjourned at 10.37 hours.
The Hearing reconvened at 11.00 hours.
The Chair welcomed all parties to the hearing and invited all those present to introduce themselves. All parties did so.
The Chair outlined the procedure to be followed, and all parties confirmed that they understood the procedure.
The Sub-Committee’s statutory duty was to consider the application and any representations, and to take such steps as contained in the Licensing Act 2003 as it considered appropriate for the promotion of the Licensing Objectives.
Debra Craner, Section Leader – Licensing and Compliance provided an outline of the application.
The Chair invited Trading Standards to present their application. Dianne Slack, Tobacco Control Officer, did so as per Appendices 3 and 7 of the report. She stated the following: 1. On 21 November 2024, Wood End Wines was included in an organised underaged sales test purchase exercise. During this exercise, a 14 year old authorised volunteer was sold four cans of alcohol. 2. After the sale, the Premises Licence Holder was spoken to via telephone. It was confirmed that a refusals book used by the shop was not currently at the premises as it had sustained damage, although it was noted that it was not an existing condition of the Premises Licence to have a refusals book. 3. A trader’s notice was issued to the premises. 4. The Premises Licence Holder had engaged in activities that had breached the Licensing Objectives. 5. The Premises Licence Holder’s Agent had suggested conditions to be added to the Premises Licence by way of mediation. Trading Standards had considered these suggestions and had recommended amendments. 6. The sale of alcohol to a child was a very serious matter and a criminal offence and therefore any subsequent actions should be considered by the Licensing Sub-Committee. 7. Trading
Standards recommended a suspension of the Premises Licence to allow
for training and the addition of robust conditions, in particular
the implementation of a Challenge 25 policy and that the premises
sign up to a Responsible Retailer Scheme. The Chair afforded all parties present the opportunity to question Trading Standards in relation to their submission. The Tobacco Control Officer responded to questions asked. It was clarified that the length of suspension should be left to the Licensing Sub-Committee.
The Chair invited the Premises Licence Holder to make representations. Mr Rob Edge, Agent for the Applicant, did so. He stated the following: 1. Under the terms of the mediation signed by Trading Standards, the premises had implemented a seven-day suspension period to carry out robust changes and this included signing up to the City of Wolverhampton Trading Standards Responsible Retailer Scheme. 2.
