Objection Notices for a Temporary Event Notice in respect of Canalside, Castlecroft Lane, Wolverhampton, WV3 8JU had been received from West Midlands Police and Environmental Health.

 

The Chair welcomed all parties to the hearing and invited all those present to introduce themselves. All parties did so. She outlined the procedure to be followed and all parties confirmed that they understood the procedure.

 

The Sub-Committee’s statutory duty was to consider the Temporary Event Notice and any representations, and to take such steps as contained in the Licensing Act 2003 as it considered appropriate for the promotion of the Licensing Objectives.

 

Debra Craner, Section Leader – Licensing and Compliance, provided an outline of the report which had been circulated to all parties in advance of the meeting.

 

Mr Ravi Chopra, Applicant and Premises Licence Holder, confirmed that the summary was accurate.

 

The Chair invited the Applicant to present their application. Mr Ravi Chopra, Applicant and Premises Licence Holder, did so as per Appendix 1 of the report. He stated that the Temporary Event Notice was for an event to promote the opening of a new business and that approximately 30-40 business owners would be in attendance.  He stated that he had initially applied for an extension until 1am but as objections had been received, he proposed to reduce that time to 12am. He stated that live music would cease at 11pm as usual and last orders to purchase alcohol would be approximately 11.45pm – 12am.

 

Mr Sarper Dayanik, a neighbour in support of the premises, stated that he lived no more than 100 yards from the restaurant and had never experienced any issues from the premises. He stated that noise could not be heard outside the premises and that the pending licence review should not be used against Mr Chopra. He further stated that Mr Chopra had unintentionally breached his licence conditions as he had not been aware that he could not serve his staff alcohol after the permitted licensing hours.

 

The Chair afforded all parties present the opportunity to question Mr Chopra and Mr Dayanik in relation to their submissions. Mr Chopra responded to questions asked.

 

The Chair invited West Midlands Police to present their Objection Notice. Kayley Nixon, West Midlands Police, presented the grounds for the Objection Notice, as per Appendix 4 of the report. She stated that an application to review the premises licence was currently pending, and West Midlands Police would not grant a Temporary Event Notice until the Applicant had demonstrated that the Licensing Objectives were being upheld at the premises.

 

The Chair afforded all parties present the opportunity to question West Midlands Police in relation to its submission. Kayley Nixon responded to questions asked and confirmed that West Midlands Police still objected to the Temporary Event Notice despite the Applicant’s proposal to reduce the hours applied for.
